Pokiddo PlayPark Waiver, Assumption of Risk and Visitor Agreement

By entering, participating in activities at, or allowing any child in my care to enter or participate at Pokiddo PlayPark, I acknowledge and agree as follows:

1. Inherent Risks

I understand that indoor playground activities involve inherent risks, including but not limited to slipping, tripping, falling, collisions, rough play by other guests, climbing-related injuries, impact with equipment or surfaces, entrapment, sprains, strains, fractures, illness exposure, and other injuries that may occur during normal or improper use of the facility.

2. Voluntary Participation

I voluntarily choose to participate, and/or allow the child(ren) under my care to participate, in activities at Pokiddo PlayPark with full knowledge of the risks involved.

3. Parent / Guardian Responsibility

I understand that children must be supervised by a parent, legal guardian, or responsible adult at all times unless Pokiddo PlayPark expressly states otherwise in writing. I remain fully responsible for the behaviour, supervision, and safety of all children in my care.

4. Compliance with Rules

I agree that I and all children under my care will follow all posted safety rules, age restrictions, height or size restrictions, sock requirements, staff instructions, and directions regarding safe use of the facility.

5. Health Confirmation

I confirm that I, and any child in my care, are physically able to participate safely. I agree not to participate, and not to allow participation, if I know of any illness, injury, medical condition, or behavioural condition that may create a risk to that participant or others.

6. Release of Liability for Adult Claims

To the fullest extent permitted by law, I release and discharge Pokiddo PlayPark, its owners, officers, directors, employees, contractors, volunteers, affiliates, and agents from claims by me arising out of or related to my own attendance, participation, or presence at the facility, including claims based on negligence, except where liability cannot legally be excluded.

7. Minor Child Participation

I am the parent or legal guardian of the child(ren) in my care, or I have lawful authority to supervise them. I acknowledge the risks of participation and consent to their attendance and participation at Pokiddo PlayPark.

8. Indemnity

I agree to indemnify and hold harmless Pokiddo PlayPark and its related parties from claims, losses, damages, costs, or expenses arising from my actions, the actions of any child under my care, my breach of this agreement, or failure to follow facility rules or staff directions.

9. Medical Assistance

In an emergency, I authorize Pokiddo PlayPark staff to obtain emergency assistance for me or any child in my care if immediate action is reasonably necessary. I understand that I am responsible for any resulting medical or transportation costs.

10. Security Cameras and Privacy

I understand that security cameras may be used at the facility for safety, security, and incident investigation purposes. Personal information collected through admissions, bookings, incident reporting, and operations will be handled in accordance with applicable laws and Pokiddo PlayPark’s privacy practices.

11. Right to Refuse Entry or Remove Guests

Pokiddo PlayPark reserves the right to refuse admission or remove any guest for unsafe behaviour, misconduct, non-compliance with rules, illness concerns, abusive conduct, or operational or safety reasons.

12. Governing Law

This agreement is governed by the laws of Ontario and the laws of Canada applicable in Ontario.

13. Acknowledgment

By checking the box online, signing in person, or entering the facility, I confirm that I have read, understood, and agreed to this Waiver, Assumption of Risk and Visitor Agreement.
