       Indoor Playground Waiver, Release of Liability, and Policies

Section 1: Participant Information

Section 2: Acknowledgment of Risks

By signing this document, I acknowledge and agree to the following:

1. Inherent Risks: I understand and accept that participation in activities at Pokiddo Play Park involves inherent risks, including but not limited to:

• Minor injuries (scrapes, bruises, bumps).

• Serious injuries (fractures, sprains, concussions).

• Rare but severe outcomes (paralysis, death).

• Exposure to illnesses, including but not limited to COVID-19, despite enhanced cleaning protocols.

2. Voluntary Participation: I voluntarily assume these risks on behalf of myself and/or the minor(s) listed above and agree that participation is entirely at our own risk.

Section 3: Waiver, Release, and Indemnification

In consideration of being allowed to use the facilities, I hereby agree to the following:

1. Waiver of Liability: I, on behalf of myself, my child(ren), and our heirs, release Pokiddo Play Park, its owners, officers, employees, agents, and representatives from any and all liability, claims, or damages arising out of participation in activities or use of the premises, including those caused by negligence.

2. Indemnification: I agree to indemnify and hold harmless Pokiddo Play Park and its representatives from any claims, damages, or expenses arising from my or my child(ren)’s actions or failure to comply with the facility’s rules and policies.

3. Binding Agreement: This waiver is binding on myself, my child(ren), and our heirs, assigns, and legal representatives.

Section 4: Health, Safety, and Rules

Health Requirements

• Participants must be in good health, free from any symptoms of illness (e.g., fever, cough, runny nose).

• Individuals with pre-existing medical conditions, such as heart conditions or injuries, must consult a physician before participating.

Supervision

• Parents/guardians are required to supervise their child(ren) at all times.

• Pokiddo Play Park is not a licensed childcare provider and assumes no responsibility for the supervision of minors.

Safety Rules

1. All participants and adults must wear socks inside the playground. Children must wear grip socks. No bare feet or shoes are allowed.

2. Food, drinks, and gum are strictly prohibited in the play areas.

3. Climbing on or dismantling equipment in a manner not intended is strictly prohibited.

4. Running outside designated areas or rough play that may endanger others is not allowed.

5. For the safety of all guests, our fire exit must remain clear and unlocked at all times. Parents/guardians are responsible for supervising  

    their children. Pokiddo Play Park will not be held liable if a child leaves the premises unattended.

Section 5: Code of Conduct and Facility Policies

1.  All participants must follow posted rules and staff instructions at all times.

2.  Participants engaging in disruptive, unsafe, or disrespectful behavior may be asked to leave the premises without refund.

3. Damages to equipment or the facility caused by misuse will result in financial liability for repair or replacement.

Section 6: Photo and Video Release

I authorize Pokiddo Play Park to take photos or videos of myself and/or my child(ren) for marketing, promotional, or educational purposes without compensation.

Section 7: Emergency Medical Authorization

In the event of an emergency, I authorize Pokiddo Play Park and its representatives to seek medical treatment for myself or my child(ren). I assume full responsibility for any medical costs incurred.

Section 8: Legal Provisions

1. Severability: If any part of this agreement is deemed unenforceable, the remaining provisions shall remain in full force and effect.

2. Jurisdiction: This agreement shall be governed by the laws of Ontario Canada, and disputes shall be resolved exclusively within its jurisdiction.

By signing below, I confirm that I have read, understood, and agreed to all terms and conditions of this waiver and policies document. I also acknowledge that I am waiving significant legal rights, including the right to sue, on behalf of myself and/or the minor(s) listed above.
